Esango — Basque Language Learning App

These terms are written in English. Versions in Spanish (Castellano) and French (Français) are available on request at [email protected].

1. What Esango Is

Esango is an AI-powered Basque (Euskara) language learning app. You practice speaking Basque by having voice conversations with Miren, an AI conversation partner.

2. Accounts

• You must be a real person to create an account. One account per person.
• You are responsible for keeping your login credentials secure. If you believe your account has been compromised, contact us immediately.
• We reserve the right to suspend or terminate accounts that abuse the service, violate these terms, or use the app for purposes other than language learning.
• You can delete your account at any time via Settings → Account → Delete account. This permanently removes all your data.

3. Subscription and Billing

• Free tier: 5 full sessions, then 1 session every 72 hours. No time limit on the free tier.
• Premium: €7.99/month for unlimited sessions and all features.
• Billing: All payments are processed by Paddle, which acts as our merchant of record. Paddle handles invoicing, tax collection, and payment processing. Your financial relationship for billing purposes is with Paddle, not directly with Esango.
• Cancellation: You can cancel your subscription at any time. Your premium access continues until the end of your current billing period.
• Refunds: In accordance with EU consumer rights, first-time subscribers may request a refund within 14 days of their initial purchase. Refund requests should be directed to [email protected]. After the 14-day period, refunds are at our discretion.

4. Acceptable Use

Esango is designed for learning Basque. When using the app, you agree not to:

• Attempt to use Miren for purposes unrelated to language learning (e.g., generating content, seeking professional advice)
• Attempt to reverse engineer, scrape, or extract data from the app or its APIs
• Create multiple accounts to circumvent session limits or other restrictions
• Share your account credentials with others
• Use the app in any way that could harm other users or the service itself
• Attempt to manipulate Miren into producing inappropriate, harmful, or offensive content

5. Voice Data and AI

• Your voice is processed by third-party AI services to enable conversation. See our Privacy Policy for full details.
• Voice recording retention is entirely optional and separate from your ability to use the app. You can opt in or out at any time in Settings.
• We make no guarantees about the linguistic accuracy of AI-generated Basque content. Miren is designed to be helpful and natural, but she is not a certified language teacher and may make mistakes.
• Session transcripts are processed by Anthropic's Claude API. Your conversations are used to generate responses in real time and are not used by Anthropic to train their models (per their API privacy policy).

6. Intellectual Property

• The Esango app, the Miren persona, scenario content, curriculum design, and all original creative work are our intellectual property.
• The Basque language itself is, of course, not our intellectual property. We just help you learn it.
• Some speech technology models used in the app are provided by HiTZ / UPV-EHU under Apache 2.0 and CC BY 4.0 licences. Attribution: “Speech technology by HiTZ — Basque Center for Language Technology, Aholab Signal Processing Laboratory, University of the Basque Country (UPV/EHU).”
• You retain ownership of any content you create (your spoken words, your learning data). By using the app, you grant us a licence to process this content as described in our Privacy Policy.

7. Disclaimers

• Esango is provided “as is” without warranty of any kind. We do not guarantee uninterrupted, error-free service.
• We are not responsible for decisions you make based on language learned through the app.
• Miren is an AI conversation partner, not a certified language teacher, translator, or interpreter. Do not rely on Miren for professional, legal, or medical translation.
• We do our best to ensure Miren speaks natural, correct Basque, but AI language generation is imperfect. We work with native Basque-speaking language advisors to continuously improve quality.

8. Limitation of Liability

To the maximum extent permitted by Spanish law, Esango's total liability to you for any claims arising from your use of the service is limited to the amount you have paid us in the 12 months preceding the claim. This does not affect your statutory rights as an EU consumer.

9. Governing Law

These terms are governed by the laws of Spain. Any disputes arising from these terms or your use of Esango will be resolved in the courts of Navarra, Spain, without prejudice to your right as an EU consumer to bring proceedings in your country of residence.

10. Changes to These Terms

We may update these terms from time to time. For material changes, we will notify you via the email address associated with your account at least 30 days before the changes take effect. Your continued use of Esango after changes take effect constitutes acceptance of the updated terms.
